Terms of Use Agreement

This Terms of Use Agreement (the “Agreement”) constitutes a legally binding agreement by and between Robust (“Robust”, “we”, “us”, or “our”) and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of Robust’s website: https://robust.to (the “Website”) and any other media form, channel, mobile website, or mobile application related or connected thereto. Failure to agree and adhere to all terms contained herein results in the express prohibition of the Client’s use of the Website and Services, and the Client is ordered to discontinue use immediately.

1. Intellectual Property Rights

Unless otherwise indicated, the Website and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks and logos contained therein (the “Marks”) are owned or controlled by Robust. They are protected by copyright and trademark laws of the United States and international conventions. The Content and Marks are provided “As-Is” for your information and personal use only.

2. Ownership of Materials

All design and original source files created on Client’s behalf (“Projects”) belong to the Client, and the Client shall be the sole owner of the copyright for all Projects. In the event that any operation of law would cause Robust to become the owner of a Project, Robust irrevocably and perpetually assigns its entire interest in the Project to the Client.

The Client warrants that any materials provided to Robust for incorporation into a project are owned by the Client and do not infringe on any third party’s rights. Robust reserves the right to share the Client's design work publicly (social media, website, etc.) unless an NDA is explicitly agreed upon as stated in Section 11.

3. Third-Party Fonts

If a Project incorporates fonts that require a commercial license (“Third-Party Fonts”), Robust will inform the Client in writing. The Client assumes all responsibility for purchasing the necessary licenses to legally reproduce or display the Project.

4. User Representations

By using the Website, the Client represents and warrants that:

1. The Client has the legal capacity to comply with these Terms;

2. The Client is not a minor;

3. The Client will not use the Website for any illegal or unauthorized purpose;

4. The Client’s use will not violate any applicable law or regulation.

   
   

5. Prohibited Activities

The Client shall not access the Website for any purpose other than that for which it is made available. Prohibited activities include, but are not limited to: circumventing security features, unauthorized framing, harassing Robust employees or contractors, and using the Website to compete with Robust.

6. Client Feedback

The Client agrees that any feedback or suggestions (each a “Submission”) provided to Robust shall become the sole property of Robust. We shall be the exclusive owner of all rights related to the Submission and may use it for any lawful purpose without acknowledgment or compensation to the Client.

7. Returns and Refunds

Robust reserves the right to deny refunds at its own discretion. Refund requests are assessed on a case-by-case basis. If a refund is granted, all materials produced by Robust during that time remain the property of Robust and are prohibited from being used by the Client. Any non-refundable payment processing fees (e.g., Stripe fees) will not be refunded.

8. Connection Interruptions

Robust does not guarantee the Website will be available at all times. We shall not be liable for any loss, damage, or inconvenience caused by the Client’s inability to access the Website during any service interruption.

9. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which Robust is organized, without regard to conflict of law principles.

10. Disclaimer and Limitation of Liability

The Website and Services are provided on an as-is and as-available basis. Robust disclaims all warranties, express or implied. Robust and its agents shall not be liable for any direct, indirect, consequential, or incidental damages arising from the Client's use of the Website or Services.

11. Showcasing Client Work & NDAs

Robust reserves the right to share design work on digital channels (social media, website, etc.) for promotional purposes. The Client reserves the right to issue an NDA between themselves and Robust, which would void Robust's right to share or discuss the work publicly.

12. Licensing Responsibility

The Client assumes full responsibility for any unauthorized use of images, fonts, or content displayed on their final deliverables. It is the sole responsibility of the Client to ensure all content provided or requested is properly licensed.

13. Electronic Communications

The Client consents to receive electronic communications and agrees that all agreements, notices, and disclosures sent via email or through the Website satisfy any legal requirement that such communication be in writing.
